Application for a Pennsylvania License to Carry Firearms (SP 4-127)

This document is the official application form for a License to Carry Firearms (LTC) in Pennsylvania, issued by the Commonwealth of Pennsylvania. The form is dated October 2012 and includes instructions for both the applicant and the issuing authority.

Applicant Information Requirements

The first section of the form requires detailed personal information, including:

  • Personal Details: Full name (including suffix), date and place of birth, age, sex, race, physical description (height, weight, hair/eye color), and Social Security Number (optional).
  • Identification: Photo ID or Driver's License number and state.
  • Contact Information: Current residential address (street, city, state, zip) and telephone number.
  • Employment: Employer/business name, work address, work telephone number, and occupation.
  • Reason for License: Applicants must check one or more reasons: Self-Defense, Employment, Hunting/Fishing, Target Shooting, Gun Collecting, or Other.
  • References: Two references who are not family members, including their names, addresses, and telephone numbers.

Eligibility and Prohibiting Criteria

The core of the application (Section 30) asks applicants to answer "Yes" or "No" to specific questions regarding their eligibility under 18 Pa. C. S. § 6109(e)(1). These questions cover:

  • Character and reputation regarding public safety.
  • Convictions under the Controlled Substance, Drug, Device and Cosmetic Act (CSDDCA).
  • Convictions of crimes enumerated in § 6105(b) (e. g. , murder, rape, robbery, burglary).
  • Adjudication of delinquency for such crimes.
  • Involuntary commitment to a mental health facility or adjudication of incompetence.
  • Habitual drunkenness or addiction to controlled substances.
  • Pending charges for crimes punishable by imprisonment exceeding one year.
  • Dishonorable discharge from the U. S. Armed Forces.
  • Fugitive status from justice (excluding minor summary offenses).
  • Prohibition under federal law.

Additional Declarations

  • Citizenship: Applicants must declare if they are U. S. citizens. Non-citizens must provide country of birth, citizenship, and Alien Registration # or I-94#.
  • Out-of-State Licenses: Residents of other states must declare if they possess a current license to carry firearms from that state and attach a photocopy.

Legal Certification (Section 33)

The final section is a legal certification where the applicant:

  • Certifies they have never been convicted of a crime prohibiting firearm possession.
  • Certifies they are of sound mind and not committed to a mental institution.
  • Acknowledges that false statements are subject to penalties prescribed by law.
  • Authorizes the sheriff or police chief to inspect records relevant to the application.
  • Agrees to promptly notify authorities if they become ineligible to possess firearms after issuance.
  • Signs and dates the application.

Prohibiting Criteria Details (Back Page)

The second page provides detailed legal definitions for the prohibiting criteria referenced in the application:

  • Section 6105(a): Prohibits persons convicted of specific offenses from possessing firearms. This includes a finding of guilty, plea of guilty, or nolo contendere. It does not include expunged or overturned convictions unless the pardon explicitly allows firearm possession.

  • Section 6105(b): Lists specific crimes that prohibit firearm possession, such as:

    • Prohibited offensive weapons (§ 908)
    • Murder (§ 2502), Voluntary manslaughter (§ 2503)
    • Aggravated assault (§ 2702), Assault by prisoner/life prisoner (§ 2703, § 2704)
    • Stalking (§ 2709. 1), Kidnapping (§ 2901)
    • Rape (§ 3121), Involuntary deviate sexual intercourse (§ 3123)
    • Arson and related offenses (§ 3301), Burglary (§ 3502)
    • Robbery (§ 3701), Robbery of motor vehicle (§ 3702)
    • Theft by unlawful taking/disposition (second felony offense, § 3921)
    • Theft by extortion with threats of violence (§ 3923)
    • Receiving stolen property (second felony offense, § 3925)
    • False reports to law enforcement involving firearm theft (§ 4906)
    • Impersonating a public servant/law enforcement officer (§ 4912)
    • Intimidation of witnesses/victims (§ 4952), Retaliation against witness/victim/party (§ 4953)
    • Escape (§ 5121), Weapons/implements for escape (§ 5122)
    • Riot (§ 5501(3)), Prohibiting paramilitary training (§ 5515)
    • Facsimile weapons of mass destruction (§ 5516), Possession of firearm by minor (§ 6110. 1)
    • Corruption of minors (§ 6301), Sale/lease of weapons and explosives (§ 6302)
    • Any offense equivalent to the above under prior PA laws or other states' statutes.
  • Section 6105(c): Prohibits the following persons from possessing firearms:

    1. Fugitives from justice.
    2. Persons convicted of offenses under the CSDDCA or equivalent federal/state statutes punishable by imprisonment exceeding two years.
    3. Persons convicted of DUI (75 Pa. C. S. § 3802 or former § 3731) on three or more separate occasions within a five-year period (prohibition applies to transfers/purchases after the third conviction).
    4. Persons adjudicated incompetent or involuntarily committed to a mental institution for inpatient care under the Mental Health Procedures Act.
    5. Aliens illegally or unlawfully in the United States.
    6. Subjects of active Protection from Abuse (PFA) orders requiring relinquishment of firearms.
    7. Persons adjudicated delinquent for conduct that would constitute an offense under § 6105(b) if committed by an adult.
    8. Persons adjudicated delinquent for conduct that would constitute an offense under § 6105(b) with exceptions; this prohibition terminates 15 years after the last adjudication or when the person reaches age 30, whichever is earlier.
    9. Persons prohibited under federal law (18 U. S. C. § 922(g)(9)) for misdemeanor crimes of domestic violence involving current/former spouses, parents/guardians, persons sharing a child, or cohabitants.

Privacy Act Notice

  • Solicitation of information is authorized under Title 18 Pa. C. S. § 6111.
  • Providing a Social Security Number is voluntary but may be used to verify identity and prevent misidentification.
  • All information supplied, including the SSN, is confidential and not subject to public disclosure.
