Overview

The Martinsburg Police Department has issued a public safety notice regarding the operation of motorized scooters and electric-assist bicycles. This release addresses recent questions and complaints, clarifying legal requirements for these vehicles in Pennsylvania to ensure resident safety.

Motorized Scooters

The department highlights that gasoline and electric motor scooters are popular among youth but face strict regulations.

  • Definition: A 2-wheeled vehicle powered by an engine or electric motor without a seat or saddle for the driver.
  • Legal Status: Under PA Motor Vehicle Code, these are classified as "motor-driven cycles. "
  • Registration & Titling: While they technically fall under titling requirements, they do not meet the equipment standards and inspection requirements for motor vehicles. Consequently, they cannot be titled or registered in Pennsylvania.
  • Where They Can Be Driven: Because they cannot be legally registered or insured, these vehicles cannot be operated on roadways or sidewalks in Pennsylvania.
  • Permitted Use: They may only be driven on private property with the permission of the property owner.

Electric-Assist Bicycles

The release also clarifies rules for bicycles with electric assist (pedalcycles).

  • Classification: These are considered standard bicycles.
  • Requirements: They do not require titling, registration, or insurance.
  • Operator Rules:
    • A driver's license is not required.
    • The operator must be at least 16 years of age.
  • Traffic Laws: Operators must abide by all traffic laws applicable to other vehicles on the roadway.
  • Helmet Law: Children under 12 years of age are required to wear an approved bicycle helmet while operating or riding as a passenger.
