  • Landscaping: Planter, Trees, Vegetation.

Terms and Conditions

The agreement establishes specific maintenance standards for different types of improvements:

Applicant Responsibilities:

  • Murals: Must be approved in writing by the City. Anti-graffiti coating is required. Graffiti must be removed within 10 days of discovery or notification.
  • Trees: Must comply with City Shade Tree Commission guidelines and be watered regularly.
  • Vegetation/Landscaping: Must be kept free of weeds and debris.
  • Benches & Tables: Require periodic cleaning.
  • Planters: Must be watered regularly and cleaned periodically.
  • Flag Poles: Require yearly inspection reports filed with the City to ensure safety. Flags must be handled according to U. S. and Commonwealth of Pennsylvania protocol and replaced if tattered.

City Responsibilities:

  • Assist with the approval and permitting process.
  • Waive fees for the Revocable Permit associated with the project.
  • Provide short-term loans on hand tools (rakes, brooms, shovels, hoes). The City may charge for lost/damaged tools and require a deposit.
  • Provide limited liability coverage through the City’s general liability policy for approved project facets.

Liability and Removal

  • Perpetuity: The applicant agrees to maintain improvements indefinitely unless the City requests removal.
  • Hazards: If items become damaged or hazardous, the applicant must remove them immediately.
  • Replacement: The City is not responsible for replacing damaged items; the applicant may replace them in-kind with written approval.
  • Removal: The City may request removal or relocation of items at any time without prior notice. If the applicant fails to comply, the City may remove them at the applicant's expense. The applicant waives liability for such removal.
