Overview of Court Order
On September 6, 2018, the Blair County Court of Common Pleas issued an order adopting a new local rule (No. 58 of 2018) for the 24th Judicial District of Pennsylvania. This rule establishes strict regulations regarding media and electronic devices within court facilities to maintain order and privacy during judicial proceedings.
Key Regulations (Rule 1910)
The adopted rule outlines specific prohibitions and requirements for anyone entering a hearing room or courtroom:
- Prohibition on Recording: No sound recordings, photographs, video recordings, cellular phone recordings, or motion pictures may be taken of any judicial proceeding. This applies to the proceedings themselves as well as the areas immediately surrounding entrances and exits.
- Electronic Device Policy: All electronic devices—including cellular phones, tablets, laptops, and cameras—must be powered off (not just muted) while inside hearing rooms or courtrooms.
- Exceptions: Permission to activate devices or take recordings must be obtained in advance from the presiding judge, hearing officer, or their designee.
- Scope: These rules apply to the public, parties, witnesses, support staff, and attorneys. The only exception listed is for any Deputy Sheriff.
- Transmission Ban: It is strictly prohibited to transmit conversations or testimony via electronic means during or after a proceeding without prior permission.
Enforcement and Penalties
The document details the consequences for violating these rules:
- Contempt of Court: Violations may result in contempt of court charges.
- Confiscation: Law enforcement and court staff are authorized to take immediate possession of any offending device.
- Fines and Imprisonment: Penalties can include a fine of up to $1,000. 00 and/or imprisonment for up to six (6) months.
- Data Deletion: The court may order the deletion of any offending data or material from the confiscated device.
- Forfeiture: Any confiscated device not claimed by its lawful owner within seven (7) business days will be deemed forfeited to the County of Blair.
Implementation
The rule became effective thirty (30) days after its publication in the Pennsylvania Bulletin and on the Blair County Court website. The order was signed by President Judge Elizabeth A. Doyle.
