MARTINSBURG BOROUGH COUNCIL MINUTES
DECEMBER 6, 2021
The regular meeting of the Martinsburg Borough Council was held on Monday, December 6, 2021 in the municipal building. The meeting started at 7:00 p. m. with prayer by Richard Brantner, Jr. and the Pledge of Allegiance. ELECTED OFFICIALS PRESENT: Mayor Richard A. Brantner, Sr. , President P. Robert Dickson, Vice-Pres. Durban D. Metzler, Pro-tem Ed Bennett, Councilman Neil E. Gartland, Councilman Darin B. Meck, and Councilwoman Linda K. Smith (Charles E. Kensinger was absent) In addition to council, present were Manager Richard Brantner, Jr. , Secretary/Treasurer Jane Staily-(Zoom), Chief Kerry Hoover, Lt. Justin Davis, Attorney Matt Gieg, James Dell, Renee Gunnett, Jessica Sorge of the Hollidaysburg Ambulance, Sandy Weyandt, and Anna Baughman of the Morrisons Cove Herald Jessica Sorge of the HOLLIDAYSBURG AMBULANCE attended to update council on their activity. The new ambulance fund drive has started. Year to Date for 2021 there has been 658 Emergency Calls by the ambulance. She expressed their appreciation to council for the Martinsburg station. The MINUTES of the regular meeting of November 1, 2021 were approved with a correction to page 2 that the proposed 2022 Real Estate Tax was NOT an increase, on a motion by Linda Smith, seconded by Durban Metzler. The motion passed unanimously. The FINANCIAL AND TREASURER’S REPORTS for November 2021 were prepared and presented by Secretary/Treasurer Jane Staily. The LIST OF BILLS for November 2021, check nos. 10523-10552 in the amount of $108,067. 34 (including a transfer of $85,000 to the Reserve Fund) was approved on a motion by Neil Gartland, seconded by Darin Meck. The motion passed unanimously. Mayor Richard Brantner (Sr. ) presented his report as written. He also commended the borough crew for putting up the CHRISTMAS LIGHTS. Chief Hoover presented the POLICE REPORT as written. PATROLMAN ADAM HAUSER turned down the job at Huntingdon and will remain a part-time patrolman for the Borough of Martinsburg. The HUSTON TOWNSHIP Supervisors did agree to the policing agreement approved by council last month for 2022 and 2023. The department conducted an annual firearms qualification/training class. Chief Hoover attended the RHONDA RUSSELL funeral, a Blair County Corrections Officer that was killed while on duty. Attorney Matt Gieg will be contacting the civil service attorney and get things going for the CIVIL SERVICE COMMISSION. BOROUGH MANAGER Rich Brantner reported. MARTINSBURG BOROUGH COUNCIL MINUTESDECEMBER 6, 2021 – PAGE 2 Attorney Matt Gieg reported that he prepared the 2022 and 2023 HUSTON TOWNSHIP POLICE AGREEMENT. No motion was necessary as it was already approved last month subject to the township approving it. He also prepared the 2022 TAX ORDINANCES for this evening that were properly advertised. Linda Smith reported that the REVITALIZATION COMMITTEE had bad weather the day they worked on the bows so they tied them inside the conference room that day and the borough crew put the wreaths up. Council wanted to commend the committee for all they do for the town. Durban Metzler reported that we are losing our LOCAL GROCERY STORE once again at no fault of the owner since his business partner passed away. There has been some local interest in partnering with him. Manager Rich Brantner, Jr. also spoke with him and he expressed concerns about the future of the store on things such as the proposed $15/hr. minimum wage among other things. Hopefully the store won’t be closing but it looks like it might. Mayor Richard Brantner (Sr. ) reported on the W. GENE HENRY MEMORIAL FUND in Chuck Kensinger’s absence this evening. The committee still needs $2,400 more to complete the memorial. No tax money will be used towards this project. The committee is still looking for a location for the memorial. Council on a motion by Ed Bennett, seconded by Neil Gartland, adopted the 2022 BUDGET which requires NO real estate tax increase as advertised for the required 10-day public inspection period. Council on a motion by Durban Metzler, seconded by Linda Smith, adopted ORDINANCE NO. 2021-633 2022 REAL ESTATE TAX with NO millage increase. The motion passed unanimously. Council on a motion by Neil Gartland, seconded by Darin Meck, adopted ORDINANCE NO. 2021-634 2022 PER CAPITA TAX to maintain the rate of $5. 00. The motion passed unanimously. Council on a motion by Ed Bennett, seconded by Neil Gartland, adopted ORDINANCE NO. 2021-635 2022 EARNED INCOME TAX to maintain the rate of ½ of 1 percent. The motion passed unanimously. Council on a motion by Neil Gartland, seconded by Ed Bennett, adopted ORDINANCE NO. 2021-636 2022 LOCAL SERVICES TAX to maintain the rate of $52. The motion passed unanimously.

Council on a motion by Ed Bennett, seconded by Darin Meck, approved to advertise the 2022 BOROUGH COUNCIL MEETING DATES as follows. The motion passed unanimously. JAN 3 APR 4 JUL 11 (2nd Mon) OCT 3 FEB 7 MAY 2 AUG 1 NOV 7 MAR 7 JUN 6 SEP 6 (TUE) DEC 5 Council on a motion by Linda Smith, seconded by Durban Metzler, authorized the EXONERATION of seventeen individuals for the 2021-22 PER CAPITA TAX. The motion passed unanimously. After donating the purchase of the 310 E. Allegheny Street property to the borough, W. GENE HENRY also donated $10,000 more for the cost of new sidewalks. Once the sidewalks were finished there remains a balance of $2,425. 57 left from the donation. It was suggested that new chairs for the conference room be purchased with the balance. Council on a motion by Ed Bennett, seconded by Darin Meck, authorized the purchase of FOURTEEN NEW CHAIRS from McCartney’s at a cost of $198 each totalling $2,774 ($2,425. 57 of the W. Gene Henry donation balance in the General Fund plus $346. 43 from the Equipment Fund). The motion passed unanimously. Mayor Richard Brantner (Sr. ) on behalf of council and the Borough of Martinsburg presented LINDA SMITH with a gift of a clock and a sealed resolution in honor of her twelve years and ten months years of service as a Martinsburg Borough Councilwoman and for her time and dedication on the Revitalization Committee. Linda expressed her appreciation and has enjoyed her time on council and will miss it. Manager Rich Brantner, Jr. reminded council that a COUNCIL PHOTO will be taken at the January meeting to be used in the new 2022 Community Map.
