Overview
The Custody Education Program Rules (Rule 1915. 1) in Blair County, PA, aim to reduce the stress of custody disputes on children by promoting alternative dispute resolution over traditional litigation. The program is administered by the Altoona Hospital Drug and Alcohol Services.
Program Requirements
- Adults ("Children First"): Parties with children from birth to age 17 must complete this education program.
- Children ("Sandcastles"): Children aged 6 to 17 must participate in an interactive group program.
- Exemptions: Parties or children with a history of domestic violence or child abuse within the past 24 months are not compelled to attend sessions with the opposing party.
Filing and Scheduling
- Initiation: When filing a custody complaint, the moving party must attach a "Custody Scheduling Order" and program descriptions.
- Service: Copies must be served to all other parties within five (5) days of the Scheduling Order.
- Proof: The moving party must file proof of service with the Prothonotary.
Fees and Payment
- Adult Fee: $40. 00 per participant for "Children First. "
- Child Fee: $5. 00 per child for "Sandcastles," split equally between parties.
- Payment Methods: Cash, cashier's check, or money order payable to "Altoona Hospital. " Credit cards may be accepted for telephone registrations. Personal checks are not accepted.
- Refunds: Fees are non-refundable. Waivers or reductions may be considered under extreme circumstances by the District Court Administrator.
Special Relief Motions
- Screening: Motions for special relief are screened before any hearing and may be denied without a hearing.
- Scheduling: The Court Administrator schedules these motions.
- Decision: Special relief is decided on oral argument only.
