Overview of Ordinance No. 2022-637
The Borough of Martinsburg, Blair County, Pennsylvania, enacted Ordinance No. 2022-637 on September 6, 2022. This ordinance amends the existing Ordinance No. 2000-527 to establish a permit system and regulations for placing waste dumpsters on public streets.
Key Regulations
The new rules are designed to protect the health, safety, and general welfare of residents by preventing hazards associated with dumpsters in public right-of-ways.
Permit Requirements
- Mandatory Permit: No person may place a waste dumpster on a street without first obtaining a permit from the Borough.
- Duration: A standard permit is valid for ten (10) days.
- Extensions: If more time is needed, a second permit may be obtained for up to seven (7) additional days.
- Maximum Limit: No more than two permits can be issued for a single dumpster placement. After the second permit expires, the dumpster must be removed.
Fees and Insurance
- Administrative Fee: The fee for a permit or extension is $15. 00.
- Insurance: The Permittee must maintain comprehensive liability insurance of at least $100,000. 00 for property damage and personal injury.
Placement Rules
- Alley Priority: Dumpsters should not be placed on a street unless it is impossible or impractical to place them in an alley.
- Safety: Dumpsters must not extend into the travel lane, obstruct sidewalks, or close streets.
- Visibility: Dumpsters must have reflective markings to warn nighttime traffic.
- Surface Protection: If the dumpster has wheels, they must be placed on a wood pad at least 3/4 of an inch thick to prevent damage to the street surface.
- Parking Meters: If a dumpster is placed in a parking meter zone, the Martinsburg Borough Police Department must approve the location.
Violations
Each day a violation of these terms occurs constitutes a separate offense.
